Department of Transportation and Infrastructure Renewal Use of Highway Right-of-Way Water Lot Approval

Who Needs This Approval?
	Anyone in Nova Scotia who wants to utilize public highway right-of-way to gain access to a water lot immediately adjacent to highway right-of-way.

	N.S. Department of Transportation and Infrastructure Renewal
Where can you get this Approval and / or further information?
	Area Manager Any district or area office N.S. Department of Transportation and Infrastructure Renewal (See Offices: N.S. Department of Transportation and Infrastructure Renewal.)
Application Forms & Process:
	An applicant can send a letter of request along with an attached plan that clearly outlines the area for which water (riparian) rights are required, to the nearest district or area office of the N.S. Department of Transportation and Infrastructure Renewal. If all requirements are met and the Area Manager approves the request, then a form letter will be mailed to the applicant.
Waiting Period:
	1 to 10 business days Provided that all the items that must accompany the application have been received
Expiry & Renewal:
	This approval does not expire.

Related Requirements:
	If an applicant is planning to build any structure within 100 metres (330 feet) of the road, a permit will be required from the Municipality and a "Building Near A Highway and Access To Property Permit: Residential and Commercial" from the N.S. Department of Transportation and Infrastructure Renewal. A "Breaking Soil of Highways Permit" is required if work is to be done within the highway right-of-way; Permits may be required from: (a) Environment Canada; (b) Fisheries and Oceans Canada; and (c) Nova Scotia Environment.
