Ministers Consent for Building Near a Highway and Access to Property Permit: Residential and Commercial

Anyone who wants to erect a structure within 100 metres (330 feet), or
create access to a listed public highway in Nova Scotia.

An application
form and instruction
sheet can be obtained from the nearest District
or Area Office of the N.S. Department of Transportation and Infrastructure Renewal or you can download the application
form and instruction
sheet from the website. When completed, it is submitted to
the Area Manager. The applicant must provide markings at the site so
it can be located. The Area Manager or another qualified person from
the Area Office will inspect the site as required.
If all requirements are met and the application is approved, the permit
will be sent to the applicant by mail. If the application is not approved,
the applicant will be notified by mail.

The permit is valid only for the length of time stated on the permit.
It is not renewable.

No fixed fee, however, a deposit, both refundable and non-refundable, may or may not be required.

| Related Requirements: |

- If a building is to be erected, a permit is also required from the
Municipality. The minimum setback distance is normally set by the Municipality.
- For major commercial developments, a Traffic Impact Study is required.
- Approval of sewer and water must be obtained from the Nova Scotia Environment.

For commercial developments, the following items are required:
- the drainage scheme;
- entrance layout;
- internal circulation concept;
- routes for service / delivery vehicles;
- anticipated size of vehicles, parking area; and
- a description of the type of activity to be undertaken.
