Who
is regulated under the Cemetery and Funeral Services Act?
Companies and their employees who sell funeral or cemetery goods and
services for which payment in full is made prior to actually using the
purchased items by a person alive at the time the contract was signed. Companies
which sell cemetery lots are also regulated under this Act.
What is regulated?
The sale of:
1) Pre-arranged Funeral Plans -- the sale of funeral goods or services
which includes the merchandise and/or services normally provided by
a funeral home in the care and preparation of human remains for final
disposition;
2) Pre-need Cemetery Plans -- the sale of goods and services to be
supplied by a cemetery or crematorium in conjunction with the burial
or cremation of human remains, to a person alive at the time of sale
for use in the future; and
3) Cemetery Lots -- lots and niches sold by a cemetery for the burial
of human remains or cremated human remains.
Exemptions: Cemeteries
owned by a city, town, municipality, district or church or one not
formed for gain or profit are exempt, unless they contain 1,500 or
more lots in which case they are exempt only from the licensing and
lot plan requirements.
