Condominium Corporation Registration

Who Needs This Registration?
Any person or company proposing the division of land and buildings intended to be sold and used as condominiums in Nova Scotia.

Application Process:
The registration process involves the filing of documents by the developer and the acceptance by the Deputy Registrar of Condominiums.

The documents are submitted to the Department, along with the applicable fees (see Price below).

Information and documents must be filed by the developer with the Deputy Registrar of Condominiums in a particular sequence.  Included in the filing requirements are:

1) Structural Plans, for approval
2) Mechanical/Electrical Specifications. for approval
3) Surveys, for approval
4) Declaration, for approval
5) Description, for approval
6) Title Search
7) Surveyor's Certificate
8) Tax Certificate
9) Appointment of Agent
10) Municipal Certificate
11) Occupancy Permit, for every residential unit
12) Confirmation of Retail Value of Units
13) Bylaws of the corporation, for approval
14) Reserve Fund study, for approval

Note: 3 additional sets of the survey and structural plans and 4 copies of the Declaration and Bylaws must be filed.

IMPORTANT:

The Declaration, Bylaws,  plans and surveys must be filed in 3 registries. This is coordinated through the Registry of Condominiums.  The documents and fees for all 3 are collected by this office and forwarded to the Registry of Deeds and the N.S. Registry of Joint Stock Companies.

An inspection of the property by the Deputy Registrar is part of the registration process.

If all requirements are met and the application is approved, a letter confirming registration will be mailed to the applicant.

Waiting Period:
The letter of registration is normally processed within 3 to 4 weeks, once all items which must accompany the application have been received, and all requirements are met.

(Please allow several extra days for mail delivery.)

Expiry :
This registration does not expire.
Price: (No tax is charged)

Fees payable to register a condominium corporation:

To the Registry of Condominiums:
To examine and register declaration, description and bylaws for residential units

              $507.30 plus $2.15 / $1,000 of market value of units

To examine and register declaration, description and bylaws for commercial units

              $507.30 plus $6.40 / $1,000 of market value of units

To examine and register declaration, description and bylaws for recreational units

              $507.30 plus $4.25 / $1,000 of market value of units

To the Registry of Deeds:
To register declaration, description and bylaws

              $114.28 plus $11.43 / unit plus $37.38

Registry of Joint Stock Companies:
To register declaration and description

              $53.40

Payment should be made by cash, cheque or money order made out to the Minister of Finance.  A breakdown of the fees payable to each Registry should accompany the payment.

Additional Information:
What is regulated?
1) a method of registration of land and buildings intended to be sold and utilized as condominiums;


2) the method of operating a Condominium Corporation, once it has been created.

A Condominium Corporation is required to file copies of its annual financial statements and auditor's report with the Deputy Registrar of  Condominiums for approval.  Any amendment to the declaration of Bylaws must be submitted for approval and for registration with the Deputy Registrar of Condominiums.  The act provides direction on amending these documents.

After registration, condominium corporations are required to file every year: (a) an audited financial  statement; and, (b) a list of directors.
