| Who Needs This? |
New federal Transportation of Dangerous Goods Regulations were introduced on August 15, 2002. These regulations no longer include manifesting requirements for hazardous waste/waste dangerous goods. The manifesting requirements have been transferred to the Canadian Environmental Protection Act's Interprovincial Movement of Hazardous Waste Regulations under the jurisdiction of Environment Canada.
The Nova Scotia Dangerous Goods Management Regulations refer to the federal Transportation of Dangerous Goods Regulations. Therefore, any transportation of waste dangerous goods within the province must now follow the documentation requirements as outlined in the revised federal regulations. As such, the following changes are now in effect within Nova Scotia:
Manifest Requirement Changes
Manifests are no longer required by Nova Scotia Environment for the transportation of waste dangerous goods shipped within the province. Manifests have been replaced with shipping documents.
While the process for manifesting waste dangerous goods in Nova Scotia has changed, waste dangerous goods are still subject to the applicable requirements under the federal Transportation of Dangerous Goods Regulations (classification, handling, packaging, labeling, placarding, shipping, documentation, training, spill response, etc). Manifests are still required by the federal government for interprovincial or international shipments of waste dangerous goods.
The Vehicle Compliance Division of Nova Scotia Transportation and Infrastructure Renewal is primarily responsible for administering the federal Transportation of Dangerous Goods Regulations in Nova Scotia. Questions about manifests or shipping documents should be directed to this division at (902) 424-3602 or visit their Vehicle Compliance Division website.
Provincial Registration of Generators, Carriers, and Receivers
A change to the Generator (Consignor), Carrier and Receiver (Consignee) registration process is also necessary since waste manifests are no longer required for the transportation of waste dangerous goods within Nova Scotia.
Therefore, Nova Scotia Environment is no longer issuing provincial registration numbers for Generators, Carriers and Receivers. However, Carriers are still required to meet all other legislative requirements under the federal Transportation of Dangerous Goods Act and its accompanying regulations.
Also, any person or company seeking to establish themselves as a Receiver may be subject to other regulatory requirements under the applicable provincial legislation (i.e. Nova Scotia Dangerous Goods Management Regulations, Activity Designation Regulations, Environmental Assessment Regulations, etc). Questions about Generators, Carriers and Receivers should be directed to a local Environment District Office.
Questions about movement of waste between provinces and/or the federal Interprovincial Movement of Hazardous Waste Regulations should be directed to Evironment Canada's Environmental Protection Branch.
