Special Mining Lease

Who Needs This Lease?
 

A Special Mining Lease may be issued in Nova Scotia for the following: salt, potash, coal, uranium, and geothermal resources -- or for areas which have been withdrawn from the exploration licence application process.

Note: This lease covers the same items as the Mineral Exploration: Special Licence. It is not required for Gypsum or non-crown Limestone.

Application Forms & Process:
 

An application form (Form No. 13, Application for Mining Lease) can be obtained from the nearest Regional or Area Office of the N.S. Department of Natural Resources, or the Registry of Mineral and Petroleum Titles of the Department (see above). When completed, it is submitted to the Registry of Mineral and Petroleum Titles. In addition, the application form for a special mining lease must be supported with the prescribed information as outlined by Section 56 under the Mineral Resources Act. The applicant is required to submit a written undertaking to obtain a mining permit within 2 years. (See also Related Requirements, below.) If all requirements are met, and the application is approved, the applicants will be notified following a decision by the Executive Council [Provincial Government Cabinet] through the Minister of the N.S. Department of Natural Resources.

95 business days (4.5 months)

Expiry & Renewal:
 

These leases are valid for up to 20 years from the date they are issued and can be renewed for another 20 years. The renewal time is when they expire. The department will send a renewal notice six months before the lease expires.

Price:  (No tax is charged)
 

Initial Application and Annual Renewal
Lease rentals: $112.00 per claim
Royalty Payments: Royalty payments are subject to section 121 of the Mineral Resources Act; also see section 70 of Regulations under the Mineral Resources Act.

Related Requirements:
 
  1. External: Proprietorship / Partnership / Syndicated Corporate applicants are to be registered with the N.S. Registry of Joint Stock Companies.
  2. Mineral Exploration: Licence or Mineral Exploration: Special Licence; Mineral Licence: Summary of Agreement (if it exists), N.S. Department of Natural Resources.
  3. Legal survey of the boundaries of the deposit in relation to the lease bounds, unless released from this obligation under the Act.
  4. All work conducted pursuant to this Lease must be done in compliance with the Occupational Health and Safety Act, the Environment Act, and all other pertinent legislation.
