Amendment to the Land Use Bylaws

Who Needs This?
  An amendment to the Land Use Bylaw may be required for various reasons, for example, to rezone a property or to amend the uses permitted in a particular zone for any development not currently permitted by the Bylaw.

Application Forms & Process:
  You can get an application form from the Planner, Town of Yarmouth, (See Where Can you Get... above).

The application is presented to the Planning Advisory Committee, Town Council and the public.

Waiting Period:
  Approximately 3 months from the time the application is presented by the Planning Advisory Committee, unless a municipal planning strategy Amendment is required, then the waiting period may increase to 6 months. The resulting Permit is a Development Permit.
Expiry & Renewal:
  None
Price & Payment:
  $300 deposit required for the cost advertising the amendments If the total cost of advertising is less than $300, the remainder is refunded. If the cost of advertising is over $300, then the remaining cost must be paid by the applicant, before the application is processed.
Related Requirements:
  Depending on the amendment required, a municipal planning strategy Amendment may be required. If this is the case, the waiting period increases to approximately 6 months.
Additional Information:
  Land Use Bylaw Amendments may be appealed by the public or an adjacent municipality, however, if a Municipal Planning Strategy Amendment is made, the Municipal Planning Strategy Amendment is not applicable.
