Building Permit

Who Needs This Permit?
  Anyone who wants to erect, construct, add to, alter, replace or relocate any building or any part of a building or structure within the Cape Breton Regional Municipality.

Note: Situations where a building permit is not required are listed at the end of this entry under Additional Information.

Application Forms & Process:
 

You can apply in person or by mail.

When you apply, you have to provide:

1) Building plans (complete set);
2) a survey plan (for any new buildings or additions) showing where the building or addition is going on the lot;
3) a Journeyman plumber # (if plumbing work is involved) and ventilation installer;
4) the appropriate fee (See Price, below); and
5) Design Review Certificates for non-residential buildings.

After all required information and approvals, and the appropriate fees have been submitted, and the application has been reviewed by staff, the applicant will be notified by mail.

Waiting Period:
  10-15 business days.
Expiry:
  This permit is valid for 1 year from the date it is issued. It can be renewed once only. Renewal is not automatic; it is the responsibility of the permit holder to contact the municipality before it expires.

Please pay by cash, cheque or money order made out to the Cape Breton Regional Municipality.

Related Requirements:
  Some or all of the following permits or approvals may be required before this permit can be issued:
  1. Subdivision Approval, Cape Breton Regional Municipality 

  2. Building Permits cannot be issued in zoned areas within the Town until a Development Permit has been first issued.
     
  3. The Town Public Works Department must approve sewer connections
     
  4. If you are not connecting to a sewer system, you may need approval for the installation of an Sewage Disposal system [or septic tank] from the Nova Scotia Environment.
     

  5. New buildings and major renovations may require that the builder obtain Building Plans Approval (Office of the Fire Marshal, Nova Scotia Labour and Advanced Education).  This approval is not required for 1 or 2 unit family dwellings, or private accessory (storage) buildings.

  6. Municipal Fire Safety Inspection

  7. Electrical Wiring Permit, Nova Scotia Labour and Advanced Education
     
  8. If you want to erect a structure within 100 metres of the centerline of a public highway, or if you want to create a new access to a property from a public highway, you will need to get a Building Near a Highway and Access to Property Permit from the N.S. Department of Transportation.
     
  9. Any form of Eating Establishment requires a Food Establishment Permit from the N.S. Department of Agriculture & Fisheries (Food Safety Division)
Additional Information:
  Building Permits are not usually required for: 
  • Accessory buildings smaller than 10' x 10' [ten feet by ten feet] 
     
  • Temporary buildings; or
     
  • Non-structural repairs (such as siding, windows, doors) under $5,000..
