Subdivision Approval

Who Needs This Approval?
Anyone who wants to delete, create or move a property boundary within the Cape Breton Regional Municipality.

NOTE:  Larger subdivisions which involve new road construction require a Tentative Approval first.

Application Forms & Process:
You can get an application form from a local surveyor, or from the office listed above.

It should be submitted, along with 12 copies of the Subdivision plan, and the appropriate fee (see Price & Payment below) to the municipal Development Officer.

In some situations, other documents may also be required.  See Additional Information, below.

After all required documents have been submitted, and the application has been reviewed by staff, you will be notified by mail whether or not the approval has been granted.

Waiting Period:
Normally, a decision on this approval is made within 3 weeks.
Expiry:
  1. This Approval, sometimes called Final Approval, does not expire.  Once it has been granted, and the plan of subdivision is registered at the Registry of Deeds, this Approval is permanent.

  2. A Tentative Approval is valid for 2 years from the date it is issued. It cannot be renewed..
Price & Payment:  (No tax is charged)

Municipal Fee: $130.00

Plus Applicable Registry of Deeds Fees: $140.00
(This includes:
Registration of Notice of Approval of a Plan of Subdivision: $70.00, and
Registration of Plan of Subdivision: $70.00)

Registration of Deed: $70.00
Certified Copy of Plan: $10.00

Payment:  Cash or cheque (made out to the Cape Breton Regional Municipality).  No cards accepted.

Related Requirements:
  1. Separate approvals may be required dealing with water, sewer (on-site or off-site) and/or roads;

  2. Some situations require engineering designs;

  3. Sometimes deeds or affidavits of value are required.
