Residential Tenancies - FAQs - Rental Increases

When can rent be increased?

Rent can only be increased on the anniversary date of the tenancy, or, in the case of a mobile home park, on the annual rent increase date if there is one established.

Is a notice of a rental increase to be given to the tenant in writing?

Yes, the notice has to be given in writing stating the amount and the date the rent increase is to be paid.

What is the notice period for a rental increase?

Landlords are to give the tenants:

year-to-year lease: four months notice

month-to-month: four months notice

week-to-week: eight weeks notice

mobile home lot: seven months notice

The landlord is to give the notice of a rent increase prior to the anniversary date of the tenancy. The only exception to this is in a mobile home park where the landlord has set a date for all the increases to be effective.

How often can rent be increased?

The rent can only be increased once in a twelve month period.

How much can the rent be increased?

Any amount.

Can the rent be increased on a fixed term lease?

The amounts and effective dates of all the increases must be outlined before the fixed term lease is signed.

If the landlord is going to discontinue a service or privilege is this considered to be a rent increase?

Yes, it is considered to be a rent increase and the landlord is required to give the proper period of time depending on the terms of the tenancy.

Can public housing rents be increased?

Yes. Money paid in rent may increase or decrease with the tenant's income - it is not a rent increase. An increase in the percentage of income charged as rent is considered a rent increase and the landlord must give proper notice of four months prior to the anniversary date.
