Non-Binding Arbitration

Non-Binding Arbitration is a time and money-saving method of dispute resolution that has been in effect in Nova Scotia since 1994. It provides an efficient alternative to traditional arbitration hearings by having a panel consider an issue and provide a decision. This section provides information on the costs, lengths and requirements to pursue non-binding arbitration.

Our Services

The Labour Services Division of Nova Scotia Labour and Workforce Development is pleased to assist the Labour Management Forum with the administration of the Non-Binding Arbitration Program.

Unique in Canada, Non-Binding Arbitration is an alternative way to settle labour and management disputes. This conflict-resolution model has been helping employers and workers in Nova Scotia since 1994.

Please note the following:

  • Administrative fees are $125.00 per party; Panelists are paid directly by the parties at $200.00 per case;
  • In the event that there is more than one hearing scheduled per day, the Panelists are paid for each case heard, however, the administration fee is limited to $125.00 per day per party;
  • Each party pays the Panelists directly on the day of the hearing;
  • A cheque for the administration fee must accompany the request for non-binding arbitration and is non-refundable. If the hearing does not proceed, a receipt will be issued to the applicants for their record. Cheques are made payable to the Minister of Finance.

We request your continued cooperation in forwarding the agreed statement of facts prior to scheduling of the hearing. Electronic and fax submissions will expedite the scheduling process, however, we ask that you also forward the original signed hard copy for our records.
