This Bill restricts the decline in available services at retail gasoline outlets to ensure that persons in need of special assistance have access to automotive services such as the pumping of gasoline and the checking of fluid levels, tire pressure, wipers, hoses, belts, et cetera.

Be it enacted by the Governor and Assembly as follows:

1 Section 82 of Chapter 1 of the Acts of 1994-95, the Environment Act, is amended by adding ", 83A" immediately after "83" in the first line.

2 Chapter 1 is further amended by adding immediately after Section 83 the following Section:

83A (1) The purpose of this Section is to ensure that persons in need of special assistance have access to automotive services such as the pumping of gasoline and the checking of fluid levels, tire pressure, wipers, hoses, belts, et cetera.

(2) No retail or wholesaler-retailer of motive fuel may discontinue a prescribed service at a designated retail gasoline outlet without the approval of the Minister, or such other person as the Minister may designate, as provided by the regulations.

3 (1) Subsection 84(1) of Chapter 1 is amended by adding immediately after clause (s) the following clause:

(sa) upon consultation with the Retail Gasoline Dealers Association of Nova Scotia, prescribing services and designating retail gasoline outlets for the purpose of Section 83A and prescribing conditions for the discontinuance of those services;

(2) Section 84 is further amended by adding immediately after subsection (1) the following subsection:

(1A) A regulation made pursuant to clause (1)(sa) may prescribe different services for different classes of retail gasoline outlets and designate different classes of retail gasoline outlets based upon their location or upon their lack of proximity to other retail gasoline outlets offering a service prescribed pursuant to clause (1)(sa).
