Explanatory Note
This Bill permits the Governor in Council to provide for the waiver or reduction of fees and
allowances under the Costs and Fees Act, other than party and party costs.
An Act to Amend Chapter 104
of the Revised Statutes, 1989,
the Costs and Fees Act
Be it enacted by the Governor and Assembly as follows:
1 (1) Section 2 of Chapter 104 of the Revised Statutes, 1989, the Costs and Fees Act, is
amended by adding immediately after subsection (1) the following subsection:
(1A) The Governor in Council may make regulations respecting the waiver or
reduction of any fee or allowance otherwise payable pursuant to subsection (1) or the
regulations, including, without restricting the generality of the foregoing, regulations
prescribing the circumstances under which the fee or allowance may be waived and
designating a person or a class of persons who may waive or reduce the fee or
allowance.
(2) Subsection 2(2) of Chapter 104 is amended by adding "or (2)" immediately after "(1)" in the
second line.
