This Bill prohibits the retroactive charging of increased fees for services and prohibits agreements permitting retroactive charging of increased fees.
Be it enacted by the Governor and Assembly as follows:
1 Chapter 92 of the Revised Statutes, 1989, the Consumer Protection Act, is amended by adding immediately after Section 26 the following Section:
26A (1) Where a seller of services and a purchaser of services agree that the services contracted for are to be delivered by the seller at a specified cost, whether by lump-sum payment, recurring fees, instalments or otherwise, and the services have been provided on that basis, the seller may not retroactively charge any greater amount for the services than the specified cost.
(2) For greater certainty, no agreement for the provision of a service may provide for retroactive charging of any greater amount for a service after the service has been delivered.
