Be it enacted by the Governor and Assembly as follows:
1 Clause 10(a) of Chapter 55 of the Acts of 1963, the Halifax Regional Water Commission Act, as enacted by Chapter 78 of the Acts of 1973 and amended by Chapter 3 of the Acts of 1995, is further amended by
(a) striking out "or" in the second line and substituting a comma;
(b) adding "or sewage-treatment facility" immediately before "owned" in the third line; and
(c) striking out "or sewer system" in the last line and substituting ", sewer system or sewage-treatment facility".
2 Section 27 of Chapter 55 of the Acts of 1963, the Halifax Regional Water Commission Act, is repealed and the following Section substituted:
27 Notwithstanding anything contained in this Act or any enactment
(a) the Public Utilities Act does not apply to the ownership, operation, management or control by the Commission of any sewer system or sewage-treatment facility; and
(b) the Commission is not a public utility within the meaning of the Public Utilities Act with respect to its ownership, operation, management or control of any sewer system or sewage-treatment facility,
where the rates charged to the public with respect to the sewer system or sewage-treatment facility are set by the Halifax Regional Municipality.
