An Act to Amend Chapter 71
of the Acts of 1941,
The Nova Scotia Music Teachers' Act

Be it enacted by the Governor and Assembly as follows:

1 Section 4 of Chapter 71 of the Acts of 1941, The Nova Scotia Music Teachers' Act, is amended by adding "in accordance with the by-laws of the Association" immediately after "Association" in the ninth line.

2 Section 5 of Chapter 71 is amended by striking out clauses (c), (d) and (e) and substituting the following clauses:

3 Sections 7 and 8 of Chapter 71 are repealed.

4 Section 9 of Chapter 71 is amended by striking out "nine members" in the second line and substituting "that number of members as prescribed by the by-laws of the Association".

5 Chapter 71 is further amended by adding immediately after Section 9 the following Section:

6 Subsection 13(1) of Chapter 71 is amended by

(a) striking out "By-laws" in the first line and substituting "by-laws and regulations";

(b) adding ", by-laws and regulations respecting" immediately after "foregoing" in the sixth line;

(c) adding immediately after clause (c) the following clauses:

(d) striking out the period at the end of clause (i) and substituting a semicolon; and

(e) adding immediately after clause (i) the following clause:

7 Section 14 of Chapter 71 is amended by

(a) adding "person who is a" immediately after "Every" in the first line; and

(b) striking out "he" in the second line and substituting "that person".

8 Section 15 of Chapter 71 is repealed.

9 (1) Any by-law or regulation relating to the Nova Scotia Music Teachers' Association that was made at any time after the coming into force of Chapter 71 and before the coming into force of this Act either by

(a) the Council of the Association and confirmed by a general meeting of the Association; or

(b) a general meeting of the Association,

is deemed to have been authorized by Chapter 71.

(2) Nothing in subsection (1) affects the rights acquired by any person from a judgment or order given or made in litigation or proceedings commenced on or before May 22, 1998.
