Explanatory Note
This Bill makes it clear that the Freedom of Information Act
gives to the public a right of access to
(a) any facts or any analysis, study, report or background
information obtained by the expenditure of public money;
and
(b) all records in the custody of a public body that relate
to any arrangement or agreement whereby a public body
and other persons undertake and carry out, as partners,
any work or undertaking that involves the expenditure of
public money.
An Act to Amend Chapter 5
of the Acts of 1993,
the Freedom of Information Act
Be it enacted by the Governor and Assembly as follows:
1 Subsection 4(1) of Chapter 5 is amended by striking out the
period at the end and substituting the following:
and including, for greater certainty,
(a) all records that relate to any arrangement or agreement
whereby a public body and any other person, that is not a
public body, undertake and carry out, as partners, any
work or undertaking that provides for the expenditure of
money by Her Majesty in right of Province, which includes
all records that indicate the manner in which the money
will be, or has been spent; and
(b) any facts and any analysis, study, report or background
information obtained by the expenditure of money by Her
Majesty in right of the Province.
