Application for Variance

The Labour Standards Code of Nova Scotia requires that employees be given at least 24 consecutive hours off in every seven day period. The offshore petroleum sector and some others are exempt from this requirement.

Employers who are conducting special projects or undertakings may apply for a temporary exemption from this requirement.

Approval of a period of rest different from the 24 consecutive hours in a period of seven days, required by Subsections (1) and (2) of Section 66 of the Labour Standards Code of Nova Scotia

Nature and Description of Work
Describe the nature of the work to be carried out. Identify the job classifications and tasks of the employees doing the work, as well as the number of employees affected in each classification. (Please do not incude personal names of individuals.) Identify any subcontracted companies that may have employees affected by this permit. (NOTE: Subcontracted companies will need to make a separate application.)

Proposed Schedule of Work and Rest Identify the proposed work arrangements for employees during the period. Confirm whether the time off is to be paid or unpaid. Identify the normal daily shift/working hours for employee(s) affected by this permit. (Please do not incude personal names of individuals.) Confirm whether any employees are unionized. If so, identify the union(s) and provide written evidence, under separate cover, that the union(s) is in agreement with the proposed hours of work.
Confirm whether Applicant Company has a workplace Health and Safety Committee. If yes, confirm whether the terms of this variance have been reviewed by the committee. Identify how an employee is to be compensated for any holidays that fall during the work period. (E.g. will the holiday pay be included as a separate earning, included in the rate of pay, etc.) Identify the lowest daily wage rate. Identify the duration for which the permit to vary is required (both start and end date).

Note: You may be asked to provide, separate from this application, the names and signatures of affected workers indicating their consent.
