The Elevators and Lifts Appeal Board was created pursuant to the Elevators and Lifts Act which came into effect on April 1, 2002. It is an independent adjudicative tribunal charged with considering appeals filed under the Act.
Inspectors, including the Chief Inspector, in the Elevators and Lifts Inspection Services Section of the Building, Fire and Technical Safety Division are responsible for ensuring compliance with the Act. Any person aggrieved by a decision, condition or order issued by the Chief Inspector, may appeal, in writing, within 30 days to the Elevators and Lifts Appeal Board.

All decisions of the Elevators and Lifts Appeal Board are in writing and are supported by reasons. Decisions of the Board are final and binding and not open to review except in the case of an error of law or jurisdiction.

The Elevators and Lifts Appeal Board consists of three members: one mechanic, an owner or owner representative and a registered contractor, a professional engineer or an individual who has professional expertise in the installation or maintenance of elevating devices. The qualifications required by each member are established in the Elevator and Lifts General Regulations.
