Fur Buyers, Hide Dealers and Taxidermists Regulations

made under Section 113 of the

Wildlife Act

R.S.N.S. 1989, c. 504

O.I.C. 87-1183 (September 29, 1987), N.S. Reg. 207/87

Citation

1     These regulations may be cited as the Fur Buyers, Hide Dealers and Taxidermists Regulations.


Definitions

2     In these regulations

 

                (a)    “Act” means the Wildlife Act, R.S.N.S. 1989, c. 504;

 

                (b)    “Department” means the Department of Natural Resources;

                (c)    “Fur Buyer Licence” means a licence issued pursuant to these regulations conferring the privilege on the holder thereof to engage in the business of buying and selling skins and pelts of furbearing animals and bear;

 

                (d)    “Hide Dealer Licence” means a licence issued pursuant to these regulations conferring the privilege on the holder thereof to engage in the business of buying and selling the hides of deer, and moose;

                (e)    “Minister” means the Minister of Natural Resources;

                (f)    “Taxidermist Licence” means a licence issued pursuant to these regulations conferring the privilege of the holder thereof to engage in the business of the preservation or mounting of wildlife or parts thereof.


Types of licence/fee

3     (1)    The Minister may issue the following forms of licences at the rates herein specified:

 

                (a)    Fur Buyers Licence                                                              $31.17 per annum

                (c)    Hide Dealer Licence                                                            $12.48 per annum

                (e)    Taxidermist Licence                                                            $12.48 per annum

       (2)    An applicant for a Fur Buyer Licence or a Hide Dealer Licence shall file a statement with the Minister stating

 

                (a)    the name and the address of the applicant;

 

                (b)    the applicant is 19 years of age or over;

 

                (c)    the form of licence that is requested;

 

                (d)    the location of the warehouses, shops or other buildings where the pelts, skins or hides are to be stored; and

 

                (e)    the place from which the pelts, skins or hides are to be shipped out of the Province.

 

       (3)    The holder of a Fur Buyer Licence or Hide Dealer Licence shall file immediately with the Minister a statement stating any changes which may occur with respect to the information supplied in subsection (2).

 

       (4)    The Minister may authorize an employee of the Department to issue licences pursuant to these regulations.

 

       (5)    No licence is valid unless it bears the signature of an employee so authorized by the Minister.

 

       (6)    Any licence issued under these regulations expires annually on the 31st day of March.

Storage permit

4     (1)    A valid licence issued pursuant to these regulations authorizes the holder thereof to have in their possession or keep in cold storage the skins or pelts of furbearing animals, the hides of deer or moose, or other dead wildlife or parts thereof lawfully taken pursuant to the Act and these regulations.

 

       (2)    No licensed fur buyer shall have in their possession any wildlife which is required to be sealed or stamped pursuant to the Act or any regulations made pursuant to the Act unless that wildlife is sealed or stamped.

Fur buyer records

5     (1)    A person licensed as a fur buyer under these regulations shall keep a true and accurate record of all wildlife and the skins, pelts or hides thereof received by that person.

 

       (2)    The record shall include

 

                (a)    the number and specie of skins, pelts, hides or wildlife or parts thereof received;

 

                (b)    the name, address and licence number of the person from whom the items were bought or otherwise acquired;

 

                (c)    the date of the purchase or acquisition; and

 

                (d)    the disposition of the skins, pelts, hides or wildlife or parts thereof.

 

       (3)    All such entries shall be made as soon as possible after the purchase or sale and such records shall be open to inspection by a conservation officer.

 

       (4)    Unless directed otherwise, a report shall be filed with the Department at such times as required by the Minister showing

 

                (a)    the number and specie of pelts, skins, hides or wildlife or parts thereof received;

 

                (b)    the name, address and licence number of the person from whom the items were received;

 

                (c)    the number and species of pelts, skins or hides sold;

 

                (d)    the name and address of each person to whom the item was delivered or sold; and

 

                (e)    where there are no pelts, skins or hides or wildlife or parts thereof bought or otherwise acquired, submit a report to the Department stating this fact.


Buying/selling wildlife

6     (1)    The holder of a valid Fur Harvesters Licence may sell the skins or pelts or parts thereof of furbearing animals lawfully taken, to a licensed fur buyer.

 

       (2)    The holder of a valid deer hunting licence or moose hunting licence may sell the hide of a deer or moose lawfully taken, to a licensed hide dealer.

       (3)    The holder of a valid bear hunting licence or bear snaring licence may sell the hide, gall, paws, claws or teeth of a bear to a licensed fur buyer.

       (4)    No person shall have in their possession a green hide of a polar bear unless the official seal of the Province or Canadian territory is attached to it.


Section 7 repealed: O.I.C. 90-840, N.S. Reg. 177/90.


Taxidermists

8     (1)    A person licensed to carry on the business of taxidermist shall keep a true and accurate record of all wildlife, skins, pelts or hides or parts thereof of wildlife received by that person for the purpose of curing, mounting or storing the same.

       (2)    The record shall show

 

                (a)    the date the wildlife or parts thereof was received;

 

                (b)    the licence number or authority under which they are possessed;

                (c)    the date they were killed or taken; and

 

                (d)    the name and address of the owner of the wildlife.

 

       (3)    The holder of a Taxidermist Licence shall if requested by the Department provide a copy of any records required to be kept under the regulations.

       (4)    The record noted in subsection (1) shall be open to inspection to any conservation officer.

       (5)    No person who is the holder of a Taxidermist Licence shall receive or possess wildlife unless the person delivering the same furnishes proof to the holder of the Taxidermist Licence that the wildlife was lawfully taken pursuant to the Act and regulations made thereunder.

Terms and conditions of licence

9     It shall be an offence for any person to contravene any terms or conditions contained in any licence issued under these regulations.


Section 10 repealed: O.I.C. 97-521, N.S. Reg. 100/97.


Repeal of old regulations

11   Regulations made by Order in Council 75-143 dated the 26th day of August, 1975, respecting fur buyers, hide dealers and taxidermists are rescinded as of the 29th day of September, 1987.


Effective date of new regulations

12   These regulations shall come into force on and after the 29th day of September, 1987.
