Refrigeration and Air Conditioning Mechanic Trade Regulations made under Section 29 of the
Apprenticeship and Trades Qualifications Act

as amended by O.I.C. 95-833 (November 14, 1995), N.S. Reg. 169/951 (1) In these regulations
(a) "Act" means the Apprenticeship and Trades Qualifications Act;
(b) "engaged" means employed or hired for remuneration;
(c) "general regulations" means regulations made by the Governor in Council under the Apprenticeship and Trades Qualifications Act that apply generally to all designated trades;
(d) "refrigeration and air conditioning mechanic trade" or "trade" means the work performed in servicing or installing refrigeration or air conditioning equipment by a refrigeration and air conditioning mechanic who
(i) assembles or installs any component of refrigeration and/or air conditioning machinery contained in a refrigeration system which includes any or all of the following components: compressor, condenser, generator, heat exchanger, absorber, adsorber, liquid receiver, evaporator, inter-connecting piping and accessories, and who
(ii) tests, adjusts, repairs or instructs in the operation of refrigeration or air conditioning machinery contained in a refrigeration system including any or all of the components mentioned in
subsection (1) [clause (i)]; (e) "domestic refrigeration" means [a] refrigerated appliance manufactured for use primarily in a household or home.

2 The refrigeration and air conditioning mechanic trade is hereby designated as a certified trade.
3 No person shall enter into a contract of apprenticeship either as or with an apprentice in the trade unless the person being apprenticed has successfully completed the twelfth grade or its equivalent.
Section 3 replaced: O.I.C. 95-833, N.S. Reg. 169/95.4 The term of apprenticeship for the trade is four (4) years.
5 The wage of an apprentice shall be no less than is prescribed in the following wage schedule and shall include the increases to which the apprentice is entitled on successful completion of each six month period:
during the first six months at 45% of the journeyman's rate;
during the second six months at 50% of the journeyman's rate;
during the third six months at 55% of the journeyman's rate;
during the fourth six months at 60% of the journeyman's rate;
during the fifth six months at 65% of the journeyman's rate;
during the sixth six months at 70% of the journeyman's rate;
during the seventh six months at 75% of the journeyman's rate;
during the eighth six months at 80% of the journeyman's rate.6 (1) An employer in the trade may employ one refrigeration and air conditioning [mechanic] apprentice for each certified refrigeration and air conditioning [mechanic] journeyman in his employ.
(2) Notwithstanding subsection (1), the ratio of apprentices to journeymen employed by an employer in the trade may be varied from time to time with approval of the Minister after consideration of the employment situation and the availability of certified journeymen in the trade.
7 A person who
(a) satisfies the requirements of Section 19 of the general regulations; and
(b) produces evidence to prove 6 years of practical experience engaged in the trade, or 5 years if the applicant has successfully completed a vocational training course approved by the Director,
is eligible to be examined for a journeyman's certificate of qualification.

10 (1) Certificates of qualification and special certificates shall be valid for a period of five years from the date of issue or renewal.
(2) Certificates issued prior to the coming into force of these regulations shall be deemed to expire and be void on the fifth anniversary following the date of issue of the certificate.
(3) All certificates deemed to expire under this Section shall, upon application to the Director, automatically be renewed without examination for a period of five (5) years.
(4) Applications for renewal of certificates shall be made to the Director at least 20 days before the expiration of the certificate.
11 These regulations do not apply to
(a) the engine operator's trade;
(b) the manufacture and servicing of automobiles;
(c) the manufacture and servicing of ships and ship containers;
(d) the installation, servicing or repair of domestic refrigeration.
