Floorcovering Installer Trade Regulations

made under Section 29 of the
Apprenticeship and Trades Qualifications Act
S.N.S. 2003, c. 1
O.I.C. 97-565 (August 19, 1997), N.S. Reg. 114/97

1 (1) In these regulations

(a) "Act" means the Apprenticeship and Trades Qualifications Act;

(b) "engaged" means employed or hired for remuneration;

(c) "General Regulations" means regulations made by the Governor in Council under the Apprenticeship and Trades Qualifications Act that apply generally to all designated trades;

(d) "floorcovering installer trade" or "trade" means the work performed in the installation, application, alteration, repair and service of all types of carpets, rugs, artificial turf, sheet goods, tiles, specialty flooring, stair-coverings, top-set base and other floor covering or flooring products, by a floorcovering installer.

(2) Unless the context otherwise requires, words defined in the Act have the same meaning when used in these regulations.

2 No person shall enter into a contract of apprenticeship either as or with an apprentice in the trade unless the person being apprenticed

(a) is 16 years of age or older; and

(b) has successfully completed the twelfth grade or its equivalent.

3 The term of apprenticeship for the trade is 5100 hours.

4 The wage of an apprentice shall be no less than is prescribed in the following wage schedule and shall include the increases to which the apprentice is entitled on successful completion of each period

during the first 600 hours at 40% of the journeyperson's rate;

from 601-1100 hours at 45% of the journeyperson's rate;
from 1101-2100 hours at 50% of the journeyperson's rate;
from 2101-3100 hours at 60% of the journeyperson's rate;
from 3101-4100 hours at 70% of the journeyperson's rate;
from 4101-5100 hours at 80% of the journeyperson's rate.

5 (1) An employer in the trade may employ two floorcovering installer apprentices for each certified floorcovering installer journeyperson in the employer's employ.

(2) Despite subsection (1), the ratio of apprentices to journeypersons employed by an employer in the trade may be varied from time to time with approval of the Minister after consideration of the employment situation and the availability of certified journeypersons in the trade.

6 A person who

(a) satisfies the requirements of Section 19 of the General Regulations; and

(b) produces evidence to prove 7500 hours of practical experience engaged in the trade

is eligible to be examined for a journeyperson's Certificate of Qualification.
