Agricultural Fairs and Exhibitions Regulations

made under Section 160 of the
Agriculture and Marketing Act
R.S.N.S. 1989, c. 6

1 These regulations may be cited as the Agricultural Fairs and Exhibitions Regulations.

2 In these regulations

(a) "Act" means Part XV of Chapter 6, R.S.N.S. 1989, the Agriculture and Marketing Act, as amended;

(b) "Minister" means the Minister of Agriculture;

(c) "Superintendent" means a person appointed by the Minister to carry out the provisions of the Act;

(d) "secretary-manager" means a person appointed by a fair or exhibition to carry out its business affairs.

3 The Governor in Council may, from time to time, appoint a person or persons to assist the Superintendent in inspecting the property, books and accounts of any county or district exhibition receiving grants in aid under this Part [the Act and these regulations], and the officers of every such county or district exhibition, whenever required to do so by the Superintendent, shall submit its books and accounts to such inspection, and to the best of their knowledge, answer all questions put to them in relation thereto or to the funds of the society or association conducting the exhibition.

4 The Minister, subject to budgetary appropriations, may on recommendation of the Superintendent grant to any society or association in aid of an exhibition or fair under the provision of this regulation the following sums:

(a) the Atlantic Winter Fair, an amount not exceeding ten thousand dollars;

(b) an exhibition designated as Class A in accordance with Agriculture Canada regulations, an amount not exceeding five thousand dollars;

(c) an exhibition designated as Class B in accordance with Agriculture Canada regulations, an amount not exceeding three thousand three hundred dollars;

(d) an exhibition paying less than three thousand dollars in prize money, an amount not exceeding one thousand five hundred dollars;

(e) a community fair, fifty dollars together with an amount equal to fifty percent of the prize money in excess of fifty dollars, actually paid out, as shown by audited statement of such community fair, provided, however, that no more than ten local fairs in any municipality shall receive grants under this Section in any one year, nor shall the total grant in aid of such fairs in any municipality exceed five hundred dollars in any one year.

5 (1) To be eligible for grants in aid, each society or association must have filed with the Superintendent an audited financial statement satisfactory to him of the affairs of the society or association, for the preceeding year.

(2) Upon receipt of such audited statement, the superintendent may recommend payment of grants on the following basis:

(a) to all exhibitions, the grant payable shall be forwarded to the secretary-manager prior to the opening date of exhibition;

(b) grants to community fairs shall be forwarded to the secretary-manager on receipt by the Superintendent of an audited statement of such fairs setting forth the amount of prize money actually paid out on exhibits.

6 Any exhibition desiring the services of competent judges shall select dates for its exhibitions that are satisfactory to the Superintendent and Exhibition Association of Nova Scotia, and for this purpose shall submit proposed dates to the Superintendent previous to the first day of April of each year.

7 A society or association intending to hold an exhibition shall make application for a grant in aid to the Superintendent not later than the first day of June in the year in which such exhibition is to be held and shall also submit to him a prize list for his approval not later than the first day of July.

8 Every society or association conducting an exhibition and receiving a grant in aid thereof under this Part [the Act and these regulations] shall accept exhibits from any part of the Province.

9 With the exception of the employees of the Nova Scotia Department of Agriculture, exhibitions shall pay the entire cost of judges including travelling expenses and remunerations.

10 Any funds retained in the Department of Finance pursuant to Section 5 of the previous regulations respecting agricultural exhibitions made pursuant to the provisions of Part XV of the Agriculture and Marketing Act may from time to time, upon the request of the Minister, be paid to the Exhibition Association of Nova Scotia for future development of the Exhibition Association of Nova Scotia and exhibitions in Nova Scotia.
