Nova Scotia Public Trustee

For administrative purposes, the Public Trustee reports to the Minister of Justice. The Public Trustee

  • manages estates of living persons who need services of a trustee, guardian, attorney or other fiduciary not readily available in the private sector to such living persons
  • administers estates of deceased persons and has standing to apply for grant of administration or administration with will annexed in any case where no grant of probate or administration has been issued
  • may consent to medical or surgical treatment of a mentally incompetent hospital patient when consent cannot be obtained from the patient's guardian, spouse or next-of-kin
  • may act as litigation guardian or representative in litigation for minor, incompetent, deceased, missing or unascertained litigants in respect of whom a court makes representation orders
