Application Process: Transfer of Application

The Freedom of Information and Protection of Privacy Act (FOIPOP) gives the head the discretion to transfer a request, and if necessary, the record, to another public body if:

  • the record was produced by or for the other public body;
  • the other public body was the first to obtain the record; or
  • the record is in the custody or under the control of the other public body.

The FOIPOP Act requires that the transfer be done within 10 days and that the applicant be notified of the transfer.
