MINUTES

1.0 Additions

1.1 Welcome to new Members

S. Valaire made a brief announcement to welcome our newest members T Frizzell, S. Conohan and S. Jewer to the C&C Committee.

2.0 Approval of Minutes of August 21 & 22, 2000

Minutes approved by G. Dinn and seconded by J. MacIsaac.

3.0 Business Arising

3.1 Review Newsletter

A news letter was circulated from the Alberta College of Paramedics about prehospital personnel for the committee to review. The newsletter consisted of activities that their C&C Committee reported on for 1999. After a brief discussion the committee suggested that we incorporate a dollar amount into our Legislation that a portion of the annual dues be committed to C&C.

3.2 Members to update C&C mailing & telephone list

The mailing list was circulated to members to update.

3.3 Approval of the Code of Conduct plaque that will be placed in the EHSNS office

The first draft of the Code of Conduct plaque that will be placed in the EHSNS office was circulated for any changes &/or ideas. There were a few spelling mistakes to update and under Responsibilities of the Profession it was suggested to move number "3" to the next column and number "six" should be separated into two parts six & seven. As well, it was suggested that the Code of Conduct background be colored, have a watermark, fancy paper, different fonts or be placed on a scroll. All of the committee members suggestions were very helpful in making the final draft of the Code of Conduct plaque. Once it is finished the Registrar will provide it for your viewing.

Mike McKeage was given a copy of the first draft of the Code of Conduct and the pricing of 150 copies. He is checking with EMC to see if they are able to come up with the funding to purchase these for the bases across Nova Scotia.

3.4 Review memo regarding "shifts" not being covered

The memo from Dr. Cain dated September 20, 2000 regarding Committee members no longer being paid for shifts when attending Committee Meetings on scheduled work days was circulated. S. Valaire and G. Dinn volunteered to schedule a meeting with Arnold Rovers, CEO of EMC to discuss this decision further.

3.5 Update on Hearing 99-02-01 (T.C.)

The Hearing Panel's decision was for T.C. to pay a one hundred dollar ($100.00) fine by October 1, 2000, he had the option to pay before October 1, 2000 or in twenty-five dollar ($25.00) installments on July 1, 2000, August 1, 2000, September 1, 2000 and October 1, 2000. September 28, 2000 the Registrar sent T.C. a reminder letter of the Hearing Panel's decision focussing on the fine. He has 10 days from which he receives the letter from EHS (which was couriered & must have been signed to show he did receive it) to pay the $100.00 fine. If he does not he will be re-registered as "Inactive" until he pays the fine.

3.6 Review Terms of Reference

The EHSNS Conduct & Competency Committee Terms of Reference was circulated for the annual review. The question arose what does ex officio mean? It means "He sat on the committee". There were a few minor changes. Please see the attached updated C&C Terms of Reference for your records.

3.7 Open Discussion

The discussion surrounded the Paramedic/Emergency Medical Dispatcher Due Process. The committee reviewed the document and made many new changes. Ed wanted it to do to Bruce Barry for final review.

The Registrar will provide you with an updated copy after Bruce Barrie reviews it.

4.0 New Business

4.1 Alternative Decision Resolutions (ADR's)

What is the process of accepting an ADR -vs- not accepting an ADR?

When an ADR is sent out and if there is no reply from the Paramedic/EMD within 10 business days the ADR will be deemed in effect.

If the ADR is not accepted & appealed another ADR may be given (2nd & 3rd ADR's may be offered) or the case may go to a hearing.

4.2 Should the Paramedic/EMD be able to back-out after they appeal the ADR?

It was decided that the Paramedic has 3 business days before the hearing to make application to cancel the hearing and accept the last presented ADR plus all incurred expenses.

What should be do if someone doesn't show for up for a scheduled hearing?

After a lengthy discussion it was decided that the hearing would continue on without the Parmadic/EMD if they did not show up for their scheduled hearing. If the Paramedic/EMD can provide documentation of a medical reason or if a death in the immediate family occurs the hearing can be postponed to a later date if the documentation provided is approved.

If they appeal an ADR and do not show up for the hearing the Paramedic/EMD may be held responsible for expenses incurred. At this time a final decision hasn't been made on what expenses will be paid by the Paramedic/EMD

4.3 Mike McKeage

It was discussed whether Mike McKeage should continue to sit on the C&C Committee. All members were in favour of having Mike continue to sit on the committee.

4.4 Letter of Reprimand

It was asked if we had a "Formal Letter of Reprimand" that EHSNS uses. We did not therefore we reviewed some cases from the Alberta C&C Committee decisions book and found a standard "Formal Letter of Reprimand" that EHSNS will now use when a Paramedic/EMD receives one.

4.5 Formal Investigation Letters

A standard letter has been developed to advise Paramedics when an investigation will be taking place and advising them that a member of the Conduct & Competency Committee will be contacting them in the near future.

Letters sent to R.W. and P.H. informing them of an investigation that is underway.

Letter sent to J.M. regarding a Service Inquiry from Dr. Cain.
