Adjudicative Process Overview

We make appointments to adjudicative ABCs in two ways:

  • Order in Council - Order in Council (Governor in Council) appointments require both the Executive Council (Cabinet) approval and the Lieutenant Governor’s approval.
  • Ministerial - Ministerial appointments are made by the Minister responsible for the legislation that establishes the ABC. These appointments are forwarded to the Executive Council for information purposes.

Advertisements

To fill vacancies on Adjudicative boards, we place a bulk ad in provincial newspapers twice each year, in April and October. The advertisements are available to view online.

Applications

Applications (see How to Apply) are received by the Executive Council Office and then forwarded to the department assigned responsibility for the ABC. An up-to-date database of applications received and appointments made is kept at the Executive Council Office.

Screening Process

Advisory committees on adjudicative ABCs screen applications to determine which applicants are qualified to be appointed to adjudicative ABCs.

The advisory committees meet as often as required to review applications. Applications are screened against the position profiles for the ABC and the advisory committee recommends a short list of up to six qualified candidates for each position. The Minister chooses a candidate for appointment from this short list.

Approval Process

Once the screening and selection of applicants is complete, the recommendation is submitted to the Executive Council.

Adjudicative Ministerial appointments are complete after review by Executive Council.

Adjudicative Order in Council appointments are complete after Executive Council approval and upon signature by the Lieutenant Governor.

Notification

Successful applicants are notified in writing of their appointment.
