Public Highways : Right-of-Ways and Use

This section covers requirements for use of, and access to, public highways. A “highway” is defined as a “public highway or public road” (including bridges).

These requirements apply to all highways in the province that are not within the boundaries of a city or town, or owned by a municipality.

Requirement Document Act / Regulations
Attain a Work Within Highway Right-of-Way Permit for construction work that will disturb the surface, soil, or any structure within a highway right-of-way (including the road surface) in Nova Scotia. This includes installation of driveways.

Attain a Special Move Permit. Required when moving a vehicle on a public road in Nova Scotia which is heavier than the legal weight permitted (over-weight), or which is over-sized (over-dimension)

Section 11 Weights and Dimensions of Vehicles Regulations
Attain a Temporary Highway Access - Controlled Access Highways Permit (100 series highways), for the purpose of removing logs or pulpwood.

Attain an Use of Highway Right-of-Way Water Lot Approval. Required to utilize public highway right-of-way to gain access to a water lot immediately adjacent to highway right-of-way.
