Reviewing Classification Decisions for Admission to Homes for Special Care

If you are not happy with the decision made regarding your eligibility for admission into a home licensed under the Homes for Special Care Act, you can ask for a review. This is another review of your admission eligibility.

Am I Eligible to Request a Review?

You are eligible to request a review if you meet at least one of the following:

  • Your admission eligibility was based partially or fully on "untrue" facts.
  • The Field Assessment Officer did not follow the proper guidelines.
  • The Field Assessment Officer did not follow the Homes for Special Care Act and Regulations.

How long do I have to Request a Review?

You have 30 days to request a review beginning on the day that you received your decision.

How do I apply?

  • Complete and submit a Request for Review Form available from your care coordinator in the Department of Community Services Regional Office.
  • Mail the form to the Regional Administrator for your area.
  • Make sure you include any information that you want the Review Committee to consider.

How the Process Works?

  • The Regional Administrator will establish a Review Committee within ten days of receiving your request.
  • The Review Committee will review all of the material provided by you and the Field Assessment Officer.
  • The Review Committee will decide if they will review the decision.
  • If the Review Committee agrees to review the decision, they will closely re-examine the information that you provided.
  • The Review Committee may request more information from you or the Field Assessment Officer.

How long will the process take?

The Review Committee will give you a written decision within 45 days of receiving your request.

Who is not eligible?

The Review Committee may refuse to review your case if

  • You do not meet any of the eligibility criteria (see question "Am I Eligible to Request an Review").
  • The time period for review has expired (it’s been more than 30 days since you received your decision).
