ADJUDICATIVE BOARD Farm Practices Board
1 Statute Farm Practices Act and Farm Practice Board Regulations
2 Purpose The Farm Practices Board provides a structure to hear complaints and decide on normal farm practices. The Board provides a mechanism for resolving issues between farmers and their neighbours regarding odour, noise, dust, vibration, light, smoke or other disturbance resulting from a farming activity.
3 Functions The Board receives applications from persons to determine whether a disturbance is the result of a normal farm practice. The Board must determine whether the farm practice is consistent with the code of practice or in the absence of a code, consistent with other directives or accepted customs or standards of similar operations.

The Board, upon request of the Minister, may study and report on any matter related to farm practices including whether a code of practice should be developed.

4 Composition The Board consists of 7 members appointed by the Minister. Two of the members are appointed from persons recommended by the Nova Scotia Federation of Agriculture. One member is appointed from persons recommended by the Union of Nova Scotia Municipalities. One of the members is appointed by the Minister to be the Chair and Vice-chair.
5 Formal Qualifications None
6 Work & Experience Requirements Members should have past experience in community or industry related activities and possess a broad knowledge and understanding of the primary agriculture industry and agricultural land use.
7 Skills Required Members must demonstrate ability to apply: broad perspective on issues relating to the primary agriculture industry; interest and commitment to agricultural land uses; good decision-making and problem-solving abilities; objectivity and impartiality; professionalism in dealing with confidential/sensitive information; leadership to assist Board to reach consensus in a timely manner.

In addition, Chair and Vice-chairmust demonstrate proven: leadership abilities; experience in chairing organizations; communication skills.

8 Statutory Nomination Requirements Two members are appointed from persons recommended by the Nova Scotia Federation of Agriculture. One member is appointed from persons recommended by the Union of Nova Scotia Municipalities.
9 Traditional Nomination Requirements None
10 Remuneration Chair: $150/day + any reasonable/necessary expenses
Members: $100/day + any reasonable/necessary expenses
11 Anticipated Time Commitments These are part time positions. The time commitment will vary depending on the number of applications and complexity of the issues before the Board. The Board only meets upon receiving an application and/or as directed by the Minister.
12 Other Notes Members are appointed for a term not exceeding three years and may be reappointed.

A Nova Scotia Department of Agriculture and Fisheries staff person acts as Administrator to the Board.
