Explanatory Notes

Clause 1 confirms that the Emergency Management Act takes precedence over other Acts and regulations respecting emergencies and confirms the Minister's authority over all matters dealing with emergencies in the Province.

Clause 2 creates the Executive Emergency Management Committee and sets out its responsibilities.

Clause 3 requires municipalities to immediately inform EMO of any real or anticipated event or emergency that could impact the health, safety or welfare of Nova Scotians, their property or the environment.

Clause 4 increases the fine for individuals to a maximum of $10,000 and for corporations to a maximum of $100,000.

Clause 5 gives the court authority to increase any fine by an amount equal to the financial benefit acquired as a result of the commission of the offence.

Clause 6

(a) strengthens the regulation-making authority regarding the duties of municipalities; and

(b) allows regulation-making power respecting emergency planning, evaluation and reporting for non-governmental agencies.

An Act to Amend Chapter 8
of the Acts of 1990,
the Emergency Management Act

Be it enacted by the Governor and Assembly as follows:

1 Section 3 of Chapter 8 of the Acts of 1990, the Emergency Management Act, is repealed and the following Section substituted:

2 Chapter 8 is further amended by adding immediately after Section 5 the following Section:

3 Chapter 8 is further amended by adding immediately after Section 10 the following Section:

4 Section 23 of Chapter 8 is amended by striking out "to a fine not exceeding one thousand dollars or to imprisonment of not more than six months or both." in the last three lines and substituting

5 Chapter 8 is further amended by adding immediately after Section 23 the following Section:

6 Subsection 25(1) of Chapter 8, as amended by Chapter 48 of the Acts of 2005, is further amended by

(a) adding immediately after clause (ba) the following clauses:

and

(b) adding immediately after clause (c) the following clause:
