Long Term Disability Income Regulations

made under Section 35 of the
Public Service Superannuation Act
R.S.N.S. 1989, c. 377
O.I.C. 85-1403 (December 17, 1985), N.S. Reg. 237/85
as amended up to & including O.I.C. 93-173 (Feb. 16, 1993), N.S. Reg. 26/93

1 For purposes of these regulations

"LTD Plan" means a long term disability income continuance plan of the public service of Nova Scotia or a long term disability income continuance plan sponsored by any board, commission, corporation or agency of the Province of Nova Scotia as employer.

2 A person in receipt of benefit payments under a LTD Plan, shall continue to accrue pensionable service other than in respect of ill health or physical incapacity under the provisions of the Public Service Superannuation Act provided the contributions required under Section 9 of the Act continue to be made based on the current bi-weekly rate of salary for the position, class and step the person held or occupied immediately prior to the commencement of long term disability benefit payments.

3 A person who is in receipt of benefits under a LTD Plan shall not be eligible to receive an allowance provided for under the Public Service Superannuation Act with respect to ill health or physical incapacity.

3A Subject to Section 4, a person will not accrue pensionable service with respect to ill-health or physical incapacity under the Public Service Superannuation Act on, from and after the lst day of November, 1985.

4 In the event that benefits under a LTD Plan are not available a person shall be entitled to a superannuation allowance pursuant to subsection (1) of Section 4 of the Public Service Superannuation Act, provided that the person is eligible for disability benefits under the Canada Pension Plan.

5 Subject to clause[Section] 3[A] herein, these regulations shall be effective on, from and after the 1st day of May, 1985.
