Purchase of Prior Service Regulations

made under Section 20 of the
Public Service Superannuation Act
R.S.N.S. 1989, c. 377
O.I.C. 77-274 (March 29, 1977), N.S. Reg. 24/77

1 In these regulations, "Act" means Chapter 377 of the Revised Statutes of Nova Scotia, 1989, the Public Service Superannuation Act, as amended.

2 The maximum period over which an employee may pay for the purchase of prior service by payroll deductions shall be the lesser of the length of service being purchased, the length of time to the employee's sixty-fifth birthday, or seven years.

3 Notwithstanding clause [Section] 2, where an employee retires, is required to retire or becomes entitled to a superannuation allowance prior to attaining sixty-five years of age and was paying or repaying the required contributions and interest by payroll deductions for the purchase of prior service, the outstanding balance of such contributions and interest shall immediately become due and payable before any superannuation allowance is paid.

4 Notwithstanding clause [Section] 3, should an employee not make the payment required by clause [Section] 3, such employee shall receive credit under the Act for the actual years of service purchased immediately prior to retirement or death.

5 These regulations shall be deemed to be and to have been in force on, from and after the 1st day of February, 1976.
